A Federal Court judge has granted Munir Ahmad Malhi, a former head constable of Pakistan’s Punjab Police Service (PPS), another chance to remain in Canada despite a deportation order due to his alleged complicity in crimes against humanity by the PPS. Malhi, a refugee based on his Ahmadiyya faith, contended he was not involved in such crimes and only remained in the force for financial reasons. The judge found that the Immigration Division failed to adequately consider the nature of the PPS and Malhi’s rank, emphasizing that mere employment does not equate to complicity without evidence of control or responsibility over criminal actions. Malhi’s case will be reassessed in light of this ruling.
