Illinois federal appeals court upholds assault weapons ban

A federal appeals court upheld Illinois’ ban on semiautomatic weapons, maintaining the Protect Illinois Communities Act enacted in January 2023 following the deadly Highland Park parade shooting that left seven people dead and injured 36. The law restricts the sale of over 100 types of semiautomatic firearms and limits magazine capacities. In a 2-1 decision, the U.S. 7th Circuit Court of Appeals reversed a lower court ruling, stating that the law aligns with regulatory traditions and does not infringe upon Second Amendment rights. The majority opinion emphasized a correlation between the presence of assault weapons and the severity of mass shootings. Illinois Attorney General Kwame Raoul and Governor JB Pritzker praised the ruling as a victory for public safety, while the National Shooting Sports Foundation expressed disappointment and plans to appeal to the U.S. Supreme Court.

Why It Matters

The ruling reflects ongoing national debates around gun control and Second Amendment rights, particularly in light of recent high-profile mass shootings. The Protect Illinois Communities Act aims to address the increase in gun violence linked to semiautomatic firearms and high-capacity magazines. Prior to this case, the 7th Circuit had overturned previous lower court decisions against similar bans, highlighting a legal landscape where states are increasingly attempting to regulate firearms in response to public safety concerns. The U.S. Supreme Court is also set to review a related Cook County law, which may further influence gun legislation across the country.
