Ex-Blue Jays players win tax dispute in doubleheader against government

Former Toronto Blue Jays all-stars Josh Donaldson and Russell Martin have successfully challenged the Canada Revenue Agency (CRA) regarding their tax obligations, with the Federal Court of Appeal ruling that they do not owe taxes on millions in income. This decision, announced on Friday, upheld a 2024 Tax Court finding that the CRA’s calculation of their taxable income during their time in Canada was flawed. The dispute centered on the players’ pension contributions to a Retirement Compensation Agreement (RCA), with the CRA arguing that these should be deducted before calculating their 60/40 U.S.-Canada income split. Donaldson’s potential tax liability was reduced by $2 million, while Martin’s was reduced by over $3.1 million. Ultimately, both courts sided with the players, confirming their interpretation of the Income Tax Act.

Why It Matters

This ruling is significant as it addresses a crucial issue for Canadian sports teams in attracting international talent. The treatment of income for non-resident top earners, especially in the context of Canada’s higher tax rates, is a pressing concern. The use of Retirement Compensation Agreements is common among high-earning athletes and can impact their net income significantly. The outcome of this case may influence future tax policies and practices for professional athletes in Canada, as well as their willingness to engage with Canadian teams.
