Feds oppose including residential school denialism in anti-hate bill

The federal government has indicated it will not support a Senate amendment to criminalize the denial or downplaying of the residential school system within its anti-hate bill, known as Bill C-9. This amendment was defeated on Wednesday, amid ongoing challenges for the Senate to manage approximately 200,000 pieces of correspondence related to the bill. Introduced by Justice Minister Sean Fraser in September, Bill C-9 aims to address rising incidents of antisemitism and other hate crimes by creating new offences related to intimidation at places of worship and community centers. The bill has sparked controversy, particularly among Muslim advocacy groups concerned about potential overreach in targeting symbols associated with terrorist organizations. Additionally, the removal of religious defences from the Criminal Code, agreed upon with the Bloc Quebecois, has raised alarms about possible implications for religious teachings. Senators are scheduled to debate and vote on the bill shortly.

Why It Matters

The residential school system in Canada has a painful legacy, with thousands of Indigenous children forced into church-run, government-funded institutions, leading to widespread abuse and neglect. The federal government officially apologized to survivors in 2008, acknowledging the historical injustices they faced. The issue of residential schools remains a significant aspect of ongoing discussions about Indigenous rights and reconciliation in Canada. The amendment’s defeat signals complexities in addressing historical injustices within contemporary legislative frameworks, highlighting the need for continued dialogue and consultation with Indigenous communities.
