TikTok agrees to $400 million settlement in child privacy lawsuit

The US Department of Justice announced on Friday that TikTok will pay $400 million to settle a lawsuit filed in 2024 for allegedly violating the Children’s Online Privacy Protection Act (COPPA). The lawsuit claimed that TikTok collected data from children without parental consent and did not delete accounts when requested by parents. As part of the settlement, TikTok will pay $300 million immediately, with an additional $100 million contingent upon the resolution of a previous consent decree related to its predecessor, Musical.ly. This settlement marks one of the largest recoveries in a COPPA case. Additionally, the DOJ noted that TikTok has implemented significant changes to its ownership, management, and privacy practices since the lawsuit was initiated, enhancing protections for younger users.

Why It Matters

The Children’s Online Privacy Protection Act was enacted in 1998 to protect the privacy of children under 13 online, requiring parental consent for data collection. TikTok’s settlement reflects ongoing regulatory scrutiny over social media platforms and their data practices, particularly regarding minors. This case follows a broader trend of increased enforcement of privacy laws in the digital space, emphasizing the need for companies to ensure compliance with regulations aimed at protecting children. The significant financial penalty against TikTok illustrates the serious consequences companies face for privacy violations, reinforcing the importance of stringent data protection measures in the tech industry.
