Supreme Court May Dismiss Many Lawsuits Against Monsanto

The U.S. Supreme Court will hear Monsanto’s argument that federal pesticide law protects it and Bayer from numerous state lawsuits over Roundup, as the EPA has not mandated a cancer warning label. The case will determine if federal regulations preempt state failure-to-warn claims, without addressing glyphosate’s cancer risk. Monsanto asserts that the EPA has consistently found glyphosate does not cause cancer and that requiring a warning would misbrand the product. The court is expected to hear arguments in April and deliver a ruling by late June.
