A federal judge has mandated the release of Jose Trinidad Rojas Pliego, a key witness in the shooting of Lorenzo Salgado Araujo by ICE agents during a traffic stop in Houston. U.S. District Judge Keith P. Ellison’s order comes after he previously halted the federal government’s attempt to deport Rojas Pliego. The incident occurred on July 7, when ICE officers shot at the vehicle Rojas Pliego was in, killing the driver, Salgado Araujo. Rojas Pliego has been held at the Montgomery ICE Processing Center without an individualized bond determination since the shooting. Judge Ellison emphasized the need for immediate release due to the unconstitutional nature of Rojas Pliego’s detention. The government has been ordered to release him within 48 hours.

Why It Matters

This case highlights ongoing concerns regarding the use of deadly force by immigration enforcement agencies in the United States. The shooting of Lorenzo Salgado Araujo raises significant questions about the policies and practices of ICE, particularly regarding the treatment of individuals during traffic stops. Additionally, Rojas Pliego’s detention without a bond hearing underscores issues of due process within the immigration system. The judge’s ruling reflects a growing scrutiny of how immigration laws are enforced and the rights of individuals involved in these enforcement actions.
