Court Allows Social Media Addiction Lawsuits Against Meta and TikTok

Thousands of lawsuits against major social media platforms, including Instagram and TikTok, can move forward following a ruling by the U.S. Court of Appeals for the Ninth Circuit. The court denied an appeal from parent companies Alphabet, Meta, Snap, and ByteDance, which sought to overturn a lower court’s decision in California. These companies argued they were protected under Section 230 of the Communications Decency Act, which shields online platforms from liability for third-party content, claiming it also applies to allegations of promoting addictive behavior. Judge Jacqueline Hong-Ngoc Nguyen stated that immunity under Section 230 is not implied. In related cases, Meta and YouTube have been held liable for designing products that contribute to harmful and addictive behaviors among young users, with a jury awarding $6 million to a plaintiff in one such case.
