A New York City Police Department officer, Omar Habib, was found guilty of strangulation and using a prohibited chokehold, marking the first conviction under the city’s 2020 chokehold ban, which was implemented after George Floyd’s death. The Bronx Criminal Supreme Court convicted Habib of misdemeanor charges for using banned restraint tactics, alongside felony strangulation and misdemeanor assault, with the strangulation charge carrying a maximum sentence of seven years. Following his conviction, Habib was terminated from the NYPD after serving since 2007. The incident occurred in July 2023 when Habib responded to a 911 call at a Bronx catering hall, where he placed a disorderly man in a chokehold that restricted his breathing, leading to the man’s loss of consciousness. Habib had a history of misconduct complaints related to excessive force prior to this incident.

Why It Matters

This case highlights ongoing efforts to hold law enforcement accountable for excessive use of force, especially in the wake of George Floyd’s murder, which ignited nationwide protests and calls for police reform. The 2020 chokehold ban was a response to public outcry over police violence and was upheld by New York’s highest court in 2023, despite challenges from police unions. Prior to this conviction, officers who used chokeholds rarely faced criminal prosecution, underscoring a significant shift in how such cases are handled in the wake of social justice movements advocating for police accountability.
