Judge who dismissed KSM confession authored piece on military extremism

The judge overseeing the military commission for Khalid Sheikh Mohammed, accused mastermind of the September 11 attacks, has dismissed his 2007 confession, ruling it was not given voluntarily. Lt. Col. Michael Schrama’s decision, made shortly before the 25th anniversary of the attacks, could delay the trial, which is now scheduled for June 2028 instead of the previously requested January 2027. Schrama has previously expressed concerns about domestic extremism within the military, attributing it in part to conservative ideologies reinforced by right-wing groups. His criticisms have resurfaced alongside a 2023 essay advocating for changes in military law to address domestic extremism, citing that a significant percentage of domestic terrorism plots involved military personnel. The ruling has generated criticism, particularly for its timing relative to the anniversary of the attacks.

Why It Matters

Khalid Sheikh Mohammed has been detained at Guantanamo Bay since 2003, and the legal proceedings surrounding his case have been contentious and prolonged. The dismissal of his confession complicates an already lengthy process to bring him to trial, with implications for justice for the nearly 3,000 victims of the September 11 attacks. In recent years, concerns about domestic extremism in the military have grown, with studies indicating that military members have been linked to a notable percentage of domestic terrorism incidents. The legal framework governing military conduct currently lacks specific provisions to address domestic extremism, raising questions about the military’s ability to effectively manage this issue.
