DOJ may still compensate January 6 rioters without anti-weaponization fund

Even without the proposed “anti-weaponization” fund, the Trump administration can still make payouts to January 6 rioters through the existing Judgment Fund, which is designed to settle legal claims against the government. Acting Attorney General Todd Blanche informed Congress this week that the Justice Department would not advance the $1.776 billion fund after congressional Republicans rejected it during budget discussions. Critics have labeled this fund a “slush fund” for Trump associates, and it had already faced legal challenges before Blanche’s announcement. The Justice Department is required to clarify its stance on this matter to a judge ahead of a hearing scheduled for June 12, which will address multiple lawsuits related to the fund. Previously, the Trump administration had settled claims for individuals involved in the January 6 riot, including a nearly $5 million payout to the family of Ashli Babbitt, who was shot during the riot.

Why It Matters

The Justice Department’s Judgment Fund is a vital mechanism for settling claims against the government, but its use has raised concerns about potential abuse by the executive branch. Established to streamline the payment process, the fund allows for quicker settlements without congressional approval. The controversy surrounding the “anti-weaponization” fund highlights significant tensions between the executive and legislative branches regarding financial oversight and accountability. This situation underscores ongoing debates about governmental power and the implications of political favoritism in the distribution of public funds.
