In 2025, the Law Society of Ontario’s compensation fund subcommittee rejected a financial claim from Leanne Aubin, a victim of criminal defense lawyer James Bowie, who sexually exploited her and threatened her life. However, a recent court ruling has mandated the Law Society to reassess her request, potentially allowing victims of unethical lawyers to seek compensation for harm beyond financial losses. Historically, the Law Society has only compensated clients for misappropriated funds, but this ruling from Justice Andras Schreck indicates that “loss” encompasses a broader range of damages related to a lawyer’s professional conduct. Bowie, disbarred and currently imprisoned for his crimes against Aubin and others, had made repeated inappropriate offers and engaged in harassment. Aubin successfully sued him in 2024, resulting in a judgment of over $235,000 in damages.
