Serhat Aksakal, a commis chef at Odeon Bar and Restaurant, filed a complaint under the Employment Equality Act 1998 against Kivaway Ltd, alleging a senior employee, Mr Z, sexually harassed him by touching his body with his genitals. Despite the complaint leading to the senior employee’s dismissal, Mr Aksakal continued to work alongside him, claiming he was rostered together with Mr Z on several occasions. The employer disputed the allegations, suggesting collusion between Mr Aksakal and a third employee, while Mr Aksakal defended his complaint by stating language barriers and use of an online translation tool during the investigation process.
