Alberta’s top court has overturned the contempt conviction of Crown attorney James D. Wilson, who was ejected by Justice of the Peace Diane T. Luttmer during a bail hearing due to repeated interruptions while he attempted to present evidence. The Court of Appeal emphasized that the right to be heard is a fundamental principle of natural justice, asserting that Luttmer’s conduct denied Wilson the opportunity to fulfill his role in the proceedings.
