Texas court overturns injunction against midwife’s abortion clinics

An appeals court in Texas has overturned an injunction that had barred midwife Maria Rojas from operating her clinics, which were accused of performing illegal abortions. The 15th Court of Appeals found that the state did not provide adequate evidence to support the injunction issued in March 2025. Rojas, who is facing criminal charges for allegedly performing abortions without a license, is the first person sued under the Texas Human Life Protection Act, which bans abortions after six weeks. While her attorney noted that the ruling confirmed the lack of evidence against her, Rojas’ clinics have already closed, and she is on house arrest, limiting her ability to practice as a midwife. Texas Attorney General Ken Paxton plans to appeal the decision to the Texas Supreme Court.

Why It Matters

The case is significant as it highlights the ongoing legal battles surrounding abortion access in Texas, particularly following the implementation of strict anti-abortion laws. The Texas Human Life Protection Act represents one of the most restrictive abortion laws in the United States, making the prosecution of individuals like Rojas a focal point in the national debate on reproductive rights. Rojas’ situation underscores the potential consequences for healthcare providers operating in states with stringent abortion regulations, as well as the broader implications for women’s health access in Texas.
