A Calgary man, Ben Maize, 47, was found guilty of break and enter for tunneling into his upstairs neighbor’s apartment last summer. The neighbor discovered the tunnel after returning home to find her apartment locked from the inside, with evidence of disturbance but no damage. Despite the circumstantial nature of the evidence, Justice Eric Tolppanen ruled in favor of the Crown, and a stay of proceedings was entered on the mischief charge. A sentencing hearing is expected to be set on Friday.
