In an 11-page letter, they expressed that Secretary of Transportation Sean Duffy’s rationale for terminating the plan presents “considerable litigation risk” and is “unlikely” to succeed in court. Following this error, DOJ attorneys sought to seal the document, asserting it contained privileged legal guidance, while underscoring the program’s benefits for public transit funding.
