A proposed class action lawsuit has been filed in B.C. Supreme Court against the federal and B.C. governments, alleging they misled property owners regarding their rights after a ruling awarded Aboriginal title to the Quw’utsun (Cowichan) Nation on private lands. The suit claims misfeasance and seeks damages for loss of property value and mental distress, as well as a declaration of unlawful conduct. Lead plaintiff Jasjeet Rampee Grewall represents those affected by the ruling’s implications. Both governments are appealing the decision, and the lawsuit requires court certification to proceed.
