Pastor Cheryl Bartley, 48, is set to appear in Birmingham Magistrates’ Court following the tragic drowning of Robert Smith, 61, during a baptism ceremony at her ministry. Bartley has been charged with gross negligence manslaughter in connection with the incident, which occurred on October 8, 2023, at a private residence on Slade Road. Mr. Smith was participating in the baptism conducted by Life Changing Ministries in a small pool when the incident took place. The live stream of the baptism on the church’s Facebook page was abruptly cut off, and emergency services were called, but despite their efforts, Smith was pronounced dead at the scene. Bartley’s court appearance is scheduled for Thursday, May 14.

Why It Matters

This case underscores the legal responsibilities that religious leaders hold during spiritual ceremonies, particularly those involving physical risks such as baptism. Gross negligence manslaughter charges in the UK require proof that the defendant’s actions were so far below the standard of care that they posed a significant risk of death. This incident raises questions about safety protocols during religious rites and may prompt discussions about regulations governing such practices. Similar cases in the past have led to legal precedents that influence how churches and religious organizations manage their ceremonies and the safety of participants.
