Judge Dismisses Parking Ticket for Man with Gas Leak

A Saskatoon judge ruled that a driver whose truck was leaking gas should not have to pay a parking ticket issued while he stopped to avoid danger. Justice Shawn Smith noted that the driver acted out of necessity to prevent a fire hazard, as the gas was leaking significantly. Although the initial justice of the peace did not impose a penalty, the city appealed, arguing the fine was mandatory. Smith ultimately declared the driver not guilty, stating compliance with the law was impossible due to the immediate peril.
