The Department of Homeland Security has pledged to appeal the latest ruling, slamming it as ‘naked judicial activism’.
Kilmar Abrego Garcia, a Maryland man at the center of a high-profile immigration case, was released from detention by a judge’s order, which criticized ICE for detaining him without legal justification. Abrego Garcia, who has lived in the U.S. under protected status since 2019, is facing ongoing legal battles, including a federal lawsuit against the Trump administration for alleged retaliatory deportation efforts. The DHS condemned the ruling as judicial activism and plans to appeal, while his lawyer prepares to defend against further deportation attempts. Abrego Garcia also seeks to reopen his immigration case for asylum, amidst new charges of human smuggling he claims are vindictive.
