The federal government is appealing to Canada’s highest court to uphold its use of the Emergencies Act during the Freedom Convoy protests, after a lower court ruled the invocation was unlawful and violated protesters’ Charter rights. The Federal Court of Appeal agreed that the government failed to demonstrate a legitimate threat to national security, despite the government’s claims that the protests warranted extraordinary measures. The inquiry by Commissioner Paul Rouleau, however, found that the government met the threshold to invoke the act.
