Federal Judge Vacates Bump Stock Rule, Recognizes ‘Right to Possess’

Senior United States District Judge David Alan Ezra vacated the ATF’s bump stock ban rule, recognizing Michael Cargill’s right to possess the device under federal law in the Gargill v. Garland case in the U.S. District for the Western District of Texas. Following a favorable ruling against the ban in 2023, the Supreme Court’s decision led to the Fifth Circuit instructing the district court to consider relief for Cargill, resulting in Judge Ezra affirming Cargill’s rights to possess and transfer non-mechanical bump stocks under federal law.
