High Court strikes down ankle monitors and curfews for released immigration detainees

Former indefinite immigration detainees in Australia are no longer required to wear electronic monitoring ankle bracelets or adhere to curfews after the High Court deemed these measures invalid due to a previous ruling that indefinite immigration detention was illegal. This decision led to the sudden release of 150 detainees, with 215 individuals released by mid-October, including 143 wearing electronic monitoring bracelets and 126 under curfew. The court found that the government’s imposition of these restrictions was punitive and infringed upon the separation of powers, potentially resulting in a mandatory minimum one-year prison sentence for violations.
