Malema’s defamation case against Kunene dismissed due to filing error

A R1-million defamation lawsuit filed by Julius Malema, leader of the Economic Freedom Fighters (EFF), against Kenny Kunene, deputy president of the Patriotic Alliance, was dismissed by the Gauteng High Court in Johannesburg. The dismissal occurred due to an administrative error that delayed the filing of a key document on the CaseLines online legal platform, which Judge Leonard Twala noted had not been made available until the previous night. Following the ruling, Malema’s legal team is responsible for covering Kunene’s legal costs, while they plan to reinstate the case based on further instructions from Malema. The lawsuit stems from allegations made by Kunene on a podcast in February, where he claimed Malema had ties to a drug cartel referred to as the “Big Five.”

Why It Matters

This case highlights ongoing tensions within South African politics, particularly regarding public statements and their implications for reputations. Defamation lawsuits are critical in shaping the political landscape, as they can impact public perception and political careers. Malema, a prominent figure in the EFF, has previously been involved in various legal disputes that reflect broader issues of accountability and the use of media in political discourse. The outcome of this case could influence future interactions between political figures and the media in South Africa.
