Supreme Court Questions Legal Basis of Rohingya Plea

The Supreme Court of India recently addressed a habeas corpus plea regarding the alleged custodial disappearance of Rohingya individuals, questioning the legal basis for their presence in India. Chief Justice Surya Kant emphasized that without official refugee status, these individuals may be considered “intruders” and queried the obligation to grant them legal rights. The bench highlighted that illegal entry should not lead to entitlement to protections under Indian law. The petitioner’s counsel clarified that the plea sought lawful deportation, not refugee status.
