ASIC loses big as Federal Court clears Wal King and Terracom directors of misleading market

A Federal Court judge has dismissed allegations by the Australian Securities and Investments Commission (ASIC) against former Terracom directors, including Wal King, for misleading investors regarding coal quality manipulation claims. Justice Ian Jackman criticized ASIC’s case as “plainly untenable,” stating the regulator should have recognized the lack of realistic success chances for most charges, while a separate whistleblower victimization case against Terracom remains ongoing.
