Supreme Court Invalidates Tribunal Act

On Wednesday, the Supreme Court declared the Tribunal Reforms Act unconstitutional, criticizing the central government for attempts to undermine judicial independence in tribunals across various sectors. Led by Chief Justice B.R. Gavai, the bench emphasized that the Act mirrored a previously struck-down ordinance, violating principles of separation of powers. The ruling reinstates original service conditions for tribunal members, asserting that Parliament cannot override the Court’s rulings. The Court reiterated its role in enforcing constitutional supremacy, stating that legislative discretion is broad but not absolute.
